1993 Hague Convention: Note on Habitual Residence and translation of Guide to Good Practice No 1 into Vietnamese
Note on Habitual Residence and the Scope of the 1993 Hague Convention
The Permanent Bureau is pleased to announce the publication of the "Note on Habitual Residence and Scope of the 1993 Hague Convention" in English, French and Spanish.
The Spanish version of the Note has been financed by Government of Norway, and in particular the Central Authority designated under the 1993 Hague Convention – the Norwegian Directorate for Children, Youth and Family Affairs (Barne-, ungdoms- og familiedirektoratet (Bufdir)).
This Note clarifies the scope of the Convention and the concept of habitual residence and is aimed at promoting greater consistency in the determination of habitual residence in Contracting States through case scenarios. It also provides guidance on the prevention of, and response to, problems arising due to the determination of the habitual residence.
The Note is available on the HCCH website under the “Adoption Section".
